Why sell through an agent

A good local agent knows what similar homes really sold for, prepares photos and documents, screens buyers and negotiates for you. In Albania the fee is usually agreed between you and the agent, so ask for it in writing before you sign.

If you would rather sell yourself, you can also list the property for free on hyrja.al.

How much commission does an agent charge in Albania?

There is no legal minimum or maximum. Under Law No. 9/2022 “On the profession of real estate intermediary”, the fee is set in the brokerage contract, and the agent must display its general terms and fees where clients can easily read them. In practice, market guides published in 2025 and 2026 usually quote a commission of about 1% to 3% of the sale price, sometimes split between seller and buyer. The amount depends on the city, the value of the property, exclusivity and the services included.

The agent is entitled to the fee once the purpose of the contract is achieved, which normally means when the sale is signed. Compare offers in writing and always ask: is VAT included, who pays the commission, and exactly when is it due?

The steps of a sale with an agent

A sale through an agent usually follows these steps. The notary, not the agent, is the one who draws up and certifies the contracts.

  1. Valuation: the agent visits the property and proposes a price based on similar sales in the area
  2. Brokerage contract: you agree in writing on the commission, the duration and whether it is exclusive
  3. Documents: a recent ownership certificate from ASHK, the property record and the cadastral map, plus the certificate of use for a newer building
  4. Marketing: photos, a description and listings on portals such as hyrja.al
  5. Viewings and negotiation: the agent screens buyers, organises viewings and brings you offers in writing
  6. Preliminary contract at the notary: price, deposit and deadlines
  7. Final contract and payment at the notary, by bank transfer; as the seller you pay the capital gains tax before registration
  8. Registration at ASHK and handover of the keys

What to agree in the brokerage contract

Under Law No. 9/2022, the brokerage contract must be in writing, otherwise it is not valid. It must state at least who the parties are, the property, each side's rights and obligations, the fee and how it is paid, and any expenses the agent may charge you. Before you sign, check these points:

  • Exclusivity: with an exclusive contract you undertake not to use another agent for the same property. If you sell through another agent during the term, the law requires you to pay the exclusive agent's fee. If you want to keep the right to sell privately without commission, write it in explicitly
  • Duration: if the contract does not set one, the law treats it as concluded for 6 months. For an exclusive contract, a short term that can be extended is safer
  • Commission: the percentage or fixed amount, whether VAT is included, when it is paid and by whom
  • After the contract ends: if within 6 months you sell to a buyer the agent found while the contract was running, the law requires you to pay the full fee, unless the contract says otherwise
  • Extra costs: photography, advertising or paperwork are charged only if agreed in writing beforehand
  • Asking price and minimum: the agent must not accept an offer on your behalf without your approval

Also check that the agent or agency is entered in the Register of Real Estate Intermediaries kept by the Ministry of Justice. The law requires the intermediary to keep professional secrecy, to inform you of every relevant circumstance and to return your original documents at the end.
